1. Agreement to Terms

These Terms & Conditions (“Terms”) govern your access to and use of the website located at https://casablanca-shirt.com/ (the “Site”), any orders placed through the Site, and any related services provided by Casablanca Shirt (“Casablanca Shirt,” “we,” “us,” or “our”). By visiting the Site, creating an account, or making a purchase, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not use the Site.

2. Definitions

• “Customer,” “you,” or “your” means any person who accesses the Site or purchases products from us.

• “Products” means garments and accessories offered for sale on the Site.

• “Order” means a purchase request submitted via the Site for Products.

3. Eligibility

You must be at least 18 years old (or have the consent of a parent/guardian) to place an Order. By placing an Order, you represent that all information you provide is accurate and that you have the legal right to use the payment method selected.

4. Product Information & Availability

We aim to present Products, colors, sizing, and descriptions as accurately as possible. Actual colors may vary due to device display settings. Availability is not guaranteed and Products may be discontinued or limited in quantity at any time.

If an item becomes unavailable after you place an Order, we may cancel the Order (in full or in part) and issue a refund for the affected item(s).

5. Pricing, Taxes & Duties

Prices are displayed in U.S. Dollars unless otherwise stated. We may change prices at any time prior to acceptance of your Order. Taxes, shipping fees, and import duties may apply depending on your shipping address and will be shown at checkout where possible.

For international deliveries, you are responsible for any customs duties, import taxes, or brokerage fees assessed by your destination country.

6. Orders & Contract Formation

When you submit an Order, you are offering to purchase the Product(s) selected. We will acknowledge receipt of your Order via email; however, this acknowledgement does not constitute acceptance. A contract is formed only when we send a shipping confirmation email and charge your payment method.

We reserve the right to refuse or cancel any Order due to suspected fraud, pricing or stock errors, or for any reason permitted by law. If we cancel an Order after your payment has been processed, we will issue a prompt refund.

7. Payments

We accept major credit/debit cards and other payment methods as displayed at checkout. By providing a payment method, you represent that you are authorized to use it and authorize us (or our payment processor) to charge the full amount of your Order, including any applicable taxes, duties, and shipping fees.

All transactions are subject to verification and authorization by the card issuer and our payment processor.

8. Shipping & Delivery

Shipping options, costs, and estimated delivery times are listed at checkout and in our Shipping Information. Delivery times are estimates only and are not guaranteed. Risk of loss and title for Products pass to you upon delivery to the carrier or, where applicable, upon delivery to your address.

We are not liable for delays caused by customs, weather, carrier issues, or other factors beyond our control.

9. Returns & Refunds

Our return policy, including eligibility, timing, and condition requirements, is set out in our Refund & Returns Policy. To initiate a return, please follow the steps described there and retain proof of return shipment.

Refunds will be issued to the original payment method once returned items are received and inspected, subject to the policy terms.

Nothing in these Terms affects any statutory rights that may apply to you under applicable law.

10. Promotions, Discount Codes & Gift Cards

Promotional offers and discount codes are subject to their own terms and may be modified or withdrawn at any time. Unless stated, promotions cannot be combined and do not apply to previous purchases, taxes, duties, or shipping fees.

Gift cards and store credits (if offered) are non-transferable, cannot be redeemed for cash (except where required by law), and are subject to expiration and balance rules where permitted by law.

11. Accounts & Security

You may create an account to streamline checkout and view Orders. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorized use.

We may suspend or terminate accounts that violate these Terms.

12. Intellectual Property

The Site, including text, graphics, logos, images, product photography, and software, is owned by or licensed to Casablanca Shirt and is protected by intellectual property laws. You may not use, reproduce, distribute, or create derivative works from Site content without our prior written consent except as necessary to browse and purchase Products for personal, non-commercial use.

All trademarks, service marks, and trade names are the property of their respective owners.

13. Reviews & User Content

If you submit reviews, photos, or other content (“User Content”), you grant Casablanca Shirt a worldwide, royalty‑free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, publish, translate, distribute, and display such User Content in connection with the Site, our marketing, and our social channels.

You represent that you own or otherwise control the rights to your User Content, that it is accurate and not misleading, and that its use will not violate any law or infringe any rights of any person or entity.

18. Indemnification

You agree to defend, indemnify, and hold harmless Casablanca Shirt and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your violation of these Terms or your misuse of the Site or Products.

20. Dispute Resolution

Most concerns can be resolved quickly by contacting us. If we cannot resolve a dispute informally, you and we agree to resolve all claims (except those eligible for small‑claims court) through binding individual arbitration administered in New York County, New York, by a recognized arbitration provider, rather than in court, to the extent permitted by law. You and we waive any right to a jury trial and to participate in a class action.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction for the protection of intellectual property or confidential information.

22. Miscellaneous
